These general terms of use define the terms of access to and use of the MDN platform, available at moroccandiasporanetwork.com, as well as the rights and obligations of its users.<\/p>\n
In these terms, the following definitions apply: \"publisher\" means the Moroccan Diaspora Network association; \"platform\" means the site and all of its features; \"visitor\" means any person viewing the public pages; \"applicant\" means any person who has submitted a registration request; \"member\" means any person whose account has been approved; \"content\" means any item published, transmitted or submitted by a user, in any format.<\/p>\n
The platform is intended to connect Moroccans living abroad, share information useful to the community, organize work within thematic commissions, and showcase impact projects related to the Kingdom.<\/p>\n
Registering on the platform constitutes full and complete acceptance of these terms, of the Community Charter<\/a> and of the Privacy Policy<\/a>. A user who does not accept these documents must refrain from registering.<\/p>\n Acceptance results from continuing the registration process. These terms, the Community Charter and the Privacy Policy are accessible via a direct link at each step of the process, above the confirmation button, together with a notice stating that continuing registration constitutes acceptance. The publisher retains a record of the registration, its date and the version of the documents then in force, notably by means of emails sent to the applicant, for the entire duration of registration and for three years thereafter.<\/p>\n Simply browsing the public pages constitutes acceptance of the provisions of Articles 9 to 16.<\/p>\n Browsing the public pages is free and open to all. Access to the news feed, member directory, commissions, projects and private messaging is reserved for members whose account has been approved.<\/p>\n Registration is reserved for adults with legal capacity. The publisher reserves the right to terminate, without notice, any account created by a minor or by a protected adult without the required assistance.<\/p>\n Access to the service requires an internet connection, the cost of which remains the user's responsibility. The publisher provides no hardware, software or technical support.<\/p>\n Registration takes place in six steps and requires providing personal information, professional background, skills, and the nature of the desired contribution. The applicant may attach a r\u00e9sum\u00e9 or any other document useful to the review of their application.<\/p>\n The applicant guarantees the accuracy and currency of the information provided. The publisher carries out a formal review of the application. It does not verify the authenticity of declared qualifications, titles, positions or experience, nor the creditworthiness or professional authorizations of applicants, and issues no certification in this regard.<\/p>\n Each application is reviewed by the MDN team. The applicant is informed by email of the progress of the review and then of the decision. The publisher may reject an application without having to justify its decision. Rejection gives rise to no right of compensation.<\/p>\n Registration is strictly personal. Creating multiple accounts, registering under a false identity, registering on behalf of a third party, and transferring an account are prohibited.<\/p>\n Joining the association and registering on the platform are two separate acts. Registering on the platform does not, by itself, confer the status of association member within the meaning of the bylaws, nor any voting right at the general meeting.<\/p>\n The member is responsible for the confidentiality of their login credentials and for any activity carried out from their account. They must promptly inform the publisher of any unauthorized use at contact@moroccandiasporanetwork.com<\/a>.<\/p>\n Any action taken from an account is presumed to originate from its holder, unless proven otherwise by the holder.<\/p>\n The member retains ownership of the rights to the content they publish. They grant the publisher, for the duration of their registration and solely for the purposes of operating and promoting the platform, a non-exclusive, royalty-free, worldwide right to reproduce, display and technically adapt this content on the site and, where applicable, on the network's communication materials.<\/p>\n The member warrants that they hold all rights and authorizations necessary for the content published, particularly when it includes photographs, excerpts of works, personal data, or the image of third parties.<\/p>\n It is prohibited to publish:<\/p>\n The member indemnifies the publisher against any claim, action or judgment of any kind resulting from content they have published or from a breach of these terms on their part, and undertakes to compensate the publisher for all resulting costs, including defense costs.<\/p>\n The member directory and private messaging are intended for professional and associative exchanges between members. They may not be used for commercial, political or religious solicitation, nor for sending bulk messages.<\/p>\n Extracting, reusing, copying, storing outside the platform, and compiling any file from the directory's data or the network's content, including by automated means, is prohibited for any purpose. The publisher relies in this respect on the database producer's rights provided for in Articles L. 342-1 et seq. of the French Intellectual Property Code.<\/p>\n A member who processes personal data obtained on the platform becomes the data controller for that processing and is solely liable for it.<\/p>\n The publisher exercises no general monitoring of content published by members and is subject to no general obligation to seek out unlawful activity.<\/p>\n Any member may report content using the function provided for this purpose. The publisher reviews reports and may, depending on severity and in a proportionate manner:<\/p>\n Except in cases of urgency, serious harm or manifest infringement, the member is informed of the measure taken and may submit comments to contact@moroccandiasporanetwork.com<\/a> within fifteen days. The publisher responds within a reasonable time.<\/p>\n Any third party may report clearly unlawful content to contact@moroccandiasporanetwork.com<\/a>. The notice must state the date, the identity of the notifying party, a description and precise location of the disputed content, and the reasons why it should be removed. The publisher acts promptly to remove any clearly unlawful content that has been duly reported.<\/p>\n The publisher may report to the competent authorities any content likely to constitute a criminal offense and provide them, upon request, with any identifying information in its possession.<\/p>\n Termination imposed as a sanction gives rise to no right of compensation and prohibits any new registration without the publisher's express consent.<\/p>\n The structure of the site, editorial texts, visual identity, databases and custom-built features are protected by the rights of the publisher or its licensors. The name and logo are used by the association to identify its activities.<\/p>\n Any reproduction, display, adaptation or use, even partial, of these elements without prior written authorization is prohibited. No provision of these terms transfers any right to a user.<\/p>\n The publisher implements reasonable means to ensure the platform's availability. It is bound only by a best-efforts obligation. Access may be interrupted for maintenance, updates, technical constraints or force majeure, without giving rise to any right of compensation.<\/p>\n As the service is provided free of charge, the publisher may at any time modify, suspend or discontinue all or part of its features, or close the platform, by informing members by any means with reasonable notice where circumstances permit.<\/p>\n Force majeure events include, in addition to those recognized by case law, failures of communication networks, hosting or power supply services, cyberattacks, and decisions by public authorities.<\/p>\n The publisher exercises no prior control over content published by members and bears no liability for it. Its liability may only be engaged where it fails to remove clearly unlawful content after due notification.<\/p>\n Introductions made through the platform carry no guarantee as to the quality, accuracy of statements, creditworthiness, skills or authorizations of members. Relationships formed between members, including any contractual, professional or financial relationship, are their sole responsibility. The publisher is neither a party, an agent, an intermediary, nor a guarantor of these relationships.<\/p>\n Information published on the platform, including within commissions, is for informational purposes only. It does not constitute legal, tax, financial, medical or professional advice, nor an investment recommendation. Its use is at the user's sole discretion.<\/p>\n The publisher is not liable for the content of third-party sites accessible via hyperlinks from the platform.<\/p>\n The publisher's liability may under no circumstances be sought for indirect damages, in particular loss of business, loss of opportunity, loss of data, or reputational harm.<\/p>\n The processing of personal data is described in the Privacy Policy, which forms an integral part of these terms.<\/p>\n Registration is entered into for an indefinite period. The member may delete their account at any time from their personal space or by request to the publisher, without notice or justification.<\/p>\n Deleting the account results in the removal of the profile from the directory. Content published in shared spaces and commission work may be retained in anonymized form for the purpose of continuity of the network's work, and the member may not object solely on this ground.<\/p>\n The publisher may terminate registration in the event of a breach of these terms, under the conditions of Article 8, or in the event of discontinuation of the service.<\/p>\n Articles 6, 7, 9, 11 and 16 survive the termination of registration.<\/p>\n The publisher may amend these terms. Members are informed by email or by a notice displayed on the platform at least fifteen days before the new terms take effect. Continued use of the service constitutes acceptance. A member who refuses the new terms may delete their account.<\/p>\n The publisher's failure to invoke a breach does not constitute a waiver of the right to invoke it later.<\/p>\n If any provision of these terms is declared void or unenforceable, the other provisions remain in full effect, and the provision concerned is replaced by a valid provision of equivalent effect.<\/p>\n The publisher's computerized records, in particular connection logs and acceptance records, are admissible as evidence of connections, posts and acceptances, unless proven otherwise.<\/p>\n The publisher may transfer these terms and member accounts to any entity that succeeds it in its activities, in particular in the event of a merger or transformation of the association.<\/p>\n These terms are drafted in French.
